Terms & Conditions – Saddle Central

Welcome to Saddle Central! 

These Terms & Conditions govern your use of our website (saddlecentral.com.au), services, consignment of saddles and your purchase of saddles and related products from us. By accessing our website, using our services or purchasing from us, you agree to these terms. 

 

1. General Disclaimer

• Saddle Central specializes in selling second-hand saddles. Each saddle is unique, and there are no universal measurement standards across brands and models.

• All descriptions, specifications, and measurements provided on our website are our opinion and should be used as a guide only. While we strive for accuracy, we are not responsible for any discrepancies between our descriptions and the manufacturer’s specifications.

• The responsibility for determining whether a saddle is suitable for a horse and rider rests solely with the purchaser.

 

2. Saddle Descriptions & Specifications

• Details such as seat depth, seat twist, and style are provided as a guide based on our opinion and experience. They may differ from the manufacturer’s original description.

• If we describe a saddle as suitable for a certain type of horse, this is an opinion only and should not be considered a guarantee of suitability. We strongly recommend working with a professional saddle fitter to ensure the correct fit.

 

3. Sizes & Measurements

• Saddle sizes and measurements are provided based on either manufacturer stamps or our own measurements. Due to variations in how saddles are measured, these should be considered a guide only.

• Measuring saddle seat sizes accurately requires access to the bare tree, which is not possible once a saddle is made. Therefore, our measurements are approximate and may vary slightly depending on the person measuring.

• We are not responsible for any minor discrepancies in measurements.

 

4. Condition Descriptions

• Saddle condition descriptions are provided as a guide based on our assessment. This includes wear, scratches, and fading, which are normal in second-hand saddles.

• Major flaws or damage will be noted, but small nicks, scratches, and general wear may not be individually detailed.

• Fading is a natural part of leather aging, and minor fading should be expected. Extensive fading will be noted at our discretion.

• Photos are the best representation of a saddle’s condition. If you require additional images of specific areas, you must request them before purchasing.

 

5. Flocking & Adjustments

• The flocking in a second-hand saddle may be compacted or uneven due to previous adjustments for a prior horse.

• It is the purchaser’s responsibility to have the saddle professionally fitted and any necessary flocking adjustments made to suit their horse.

 

6. Photography & Colour Representation

• Photos are taken by Saddle Central under consistent studio lighting upon a saddle’s arrival.

• The colour and details visible in photos may vary depending on your device, screen resolution, and settings.

• If you require additional images of specific saddle features, please request them before purchasing.

 

7. Saddle Trials, Change of Mind Returns, Order Cancellations & Amendments.

• Our 7-day trial policy is subject to our Trial Terms & Conditions, which are available on our website.

• Some saddles are not eligible for a trial, including (but not limited to) international sales, financed purchases, Afterpay purchases, or purchases made using a “no trial” coupon code.

• Saddles that do not qualify for a trial cannot be returned for change of mind.

• Orders paid by bank transfer or or credit card can be cancelled prior to despatch, cancellation fees may apply. Orders paid any other way can not be cancelled. 

• Order amendments. ie swapping products, prior to despatch will incur a fee.   ​​

 

8. Faulty Goods & Consumer Guarantees

• All saddles are inspected before sale. If you believe a saddle has a serious fault that makes it unsafe or not fit for purpose, you must notify us within 48 hours of receipt with supporting evidence (e.g., photos).

• We will assess the issue and, if the saddle does not meet consumer guarantees under Australian Consumer Law, we will provide a suitable remedy (repair, replacement, or refund).

• This policy does not affect your rights under the Australian Consumer Law (ACL).

 

9. International Sales

• International orders are final sale and cannot be returned or exchanged.

• The buyer is responsible for any customs duties, taxes, or import fees imposed by their country.

 

10. Limitation of Liability

• Saddle Central is not liable for any loss, injury, or damage resulting from the use of a purchased saddle.

• It is the purchaser’s responsibility to ensure the saddle is safe and suitable for their needs before use.

 

12. Consignment Sales

12.1 Role of Saddle Central

• Saddle Central acts as an intermediary to facilitate the sale of second-hand saddles on behalf of their owners (“Consignors”). We do not take ownership of consigned saddles unless explicitly stated in a purchase agreement.

• By listing a saddle with Saddle Central, the Consignor agrees that we will market and sell the saddle on their behalf under the terms outlined in our Consignment Agreement Email.

 

12.2 Pricing & Sale Terms

• The sale price of a consigned saddle is determined based on our assessment, and agreement with the Consignor.  Saddle Central reserves the right to add temporary promotions or offer discounts as necessary to facilitate a sale, in accordance with the Consignment Agreement Email and the promo options the consignor has opted into.

• Once a saddle is sold, (even if still within the trial period) the Consignor cannot withdraw the saddle from sale.

 

12.3 Condition & Representations

• The Consignor is responsible for providing accurate information about their saddle, including its condition, brand, model, size, and any modifications.

• Saddle Central will assess and describe the saddle to the best of our ability, but we do not guarantee accuracy or completeness of descriptions.

• If a buyer raises a concern about a significant undisclosed defect that affects the saddle’s safety or usability, we will contact the Consignor to discuss potential resolutions. However, the ultimate liability for misrepresented saddles remains with the Consignor.

 

12.4 Payouts & Fees

• The Consignor will be paid the agreed percentage of the sale price after the buyer’s trial period (if applicable) has ended and the sale is finalised. Payments are processed within 7 days after the sale is finalised.

• All consignment fees, and any additional costs (such as cleaning or repairs) will be deducted from the final sale amount before payment to the Consignor.

 

12.5 Saddle Returns & Buyer Disputes

• If a buyer returns a saddle under our Trial Terms & Conditions, the saddle remains the property of the Consignor, and it will be relisted for sale.

• If a dispute arises regarding a saddle’s condition or authenticity, Saddle Central will act in good faith to resolve the matter.

 

12.6 Unsold Saddles

• If a saddle does not sell and either Saddle Central or the consignor wishes to terminate the consignment agreement the Consignor may choose to collect it or have it returned at their expense. A withdraw from consignment fee may apply.

• If the Consignor fails to arrange collection or shipping within 30 days of the consignment agreement being terminated, Saddle Central reserves the right to donate or dispose of the saddle at its discretion.

 

13. Website Use & Security

• Access & Use: You may use our website (saddlecentral.com.au) only for lawful purposes. Unauthorized use, including hacking, data scraping, or interfering with the website’s functionality, is strictly prohibited.

• Accuracy of Information: While we strive to keep website content up to date, we do not guarantee that all information is accurate, complete, or free from errors. We reserve the right to correct or update information at any time.

• Third-Party Links: Our website may contain links to third-party websites. We are not responsible for the content, security, or privacy practices of these external sites.


 

14. Privacy & Data Protection

14.1 Compliance with Privacy Laws

Saddle Central is committed to protecting your personal information in compliance with:

• The Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) (Australia)

• The General Data Protection Regulation (GDPR) (European Union)

• The California Consumer Privacy Act (CCPA) (California, USA)

By using our website and purchasing from us, you agree to the collection, use, and storage of your personal data as described in this section.
